Myth 1: “You must be a celebrity or world-famous.”

What matters is recognition among professionals in your field.
Myth 2: “It’s only for older people with decades of experience.”
Truth: Age is not a requirement. EB-1A looks at what you’ve achieved in the time you’ve been working in your field. Even a young person can qualify if they have risen above their peers. For EB-1A purposes, she wouldn’t be compared to veterans like Viola Davis or Denzel Washington, who have worked for decades. Instead, she would be evaluated against others at a similar career stage. The key question is: In the time you’ve been active, have you achieved more than most others in your field within the same timeframe?
Myth 3: “You need a Nobel Prize or Olympic medal.”
Truth: A one-time, world-renowned award makes the process easier, but most applicants qualify without them. Instead, they meet at least 3 of the 10 EB-1A criteria set by U.S. immigration.
The Criteria
The EB1A requires extensive documentation of qualifying evidence to prove the petitioner’s extraordinary ability and sustained acclaim. USCIS officers use a two-step analysis to evaluate the evidence submitted with the petition to demonstrate eligibility for classification as a person with extraordinary ability.
To qualify, the petitioner must FIRST meet at least 3 of the 10 regulatory criteria or provide evidence of a one-time achievement (e.g., a major internationally recognized award such as a Nobel Prize). Below is a detailed guide to each of the 10 regulatory criteria:
- Receipt of Lesser Nationally or Internationally Recognized Prizes or Awards for Excellence in the Field of Endeavor
- Membership in Associations That Require Outstanding Achievements
- Published Material About You in Professional or Major Trade Publications or Major Media
- Participation as a Judge of the Work of Others Either Individually or on a Panel
- Original Scientific, Scholarly, Artistic, Athletic, or Business-Related Contributions of Major Significance
- Authorship of Scholarly Articles in Professional or Major Trade Publications
- Display of Your Work at Artistic Exhibitions or Showcases
- Performance in a Leading or Critical Role for Distinguished Organizations
- High Salary or Other Significantly High Remuneration in Relation to Others in the Field
- Commercial Success in the Performing Arts
Comparable Evidence
USCIS officers may consider comparable evidence in support of petitions for persons working in science, technology, engineering, or mathematics (STEM) fields. Specifically, if a petitioner demonstrates that a particular criterion does not readily apply to the person’s occupation, the petitioner may submit evidence that is of comparable significance to that criterion to establish sustained acclaim and recognition.
Second Part of the Evaluation: Final Merits Determination
Meeting at least 3 criteria is a threshold requirement, but not a guarantee of approval. In the second step of the analysis, USCIS considers the petition in its entirety to determine eligibility by conducting a Final Merits Determination. This assesses whether the evidence collectively demonstrates that:
- The petitioner has sustained national or international acclaim in their field of expertise
- The petitioner is one of the small percentage who has risen to the very top of the field
- The petitioner will continue to work in their field of extraordinary ability in the U.S.
- The petitioner’s entry will substantially benefit the United States
